H-2A Visas

Allows U.S. employers to bring foreign workers for temporary or seasonal agricultural jobs

Requirements:

• Job must be temporary or seasonal
• Employer must prove a lack of sufficient U.S. workers
• Hiring H-2A workers must not negatively affect wages or conditions for U.S. workers
• Typically requires a temporary labor certification from the U.S. Department of Labor

Eligible Countries:

• H-2A visas are only available to nationals from countries designated by the Secretary of Homeland Security. The list is published annually in the Federal Register.
• Nationals from non-listed countries may be eligible in special circumstances if it serves U.S. interests.
