Application Process:

Employer files a Labor Condition Application (LCA) to ensure compliance with wage regulations. Visa Petitions are subject to a yearly cap (65,000 visas + 20,000 for U.S. advanced degree holders)

Costs:

Employers pay required fees, including filing fees and fraud prevention charges. Certain non-profits and smaller companies have reduced fees.

Duration & Extensions:

Initial visa duration is upd to 3 years, extendable to a maximum of 6 years. There is the possibility of extending them more if pursuing a green card.

Portability & Family:

Allows faster transitions between employers (conditions apply). The spouses and children (under 21) can apply for H-4 Dependent visas.
