TN Visas

Eligibility:

The TN-1 and TN-2 visas are designated for Canadian and Mexican citizens who are entering the U.S. temporarily for professional business activities under the North American Free Trade Agreement (NAFTA). These visas are available to individuals in various professions, including accountants, engineers, attorneys, pharmacists, scientists, teachers, and other occupations listed under NAFTA.

Application Process:

• Canadian Citizens: The TN visa can be applied for in person at U.S. ports of entry, including major Canadian international airports. Applications are typically approved on the same day.
• Mexican Citizens:Mexican citizens must apply directly with the U.S. embassy or consulate. Unlike the H-1B and L-1 visas, there is no need for a separate petition with U.S. Citizenship and Immigration Services (USCIS).

Benefits:

There is no annual cap on the number of TN-1 and TN-2 visas issued. These visas can be granted for an initial three-year period and can be extended in three-year increments indefinitely, allowing the visa holder to maintain their status as long as they continue to meet the eligibility requirements.

Intent to Return:

Applicants must maintain a foreign residence and intend to return at the end of the authorized stay; prolonged stay may affect future extension applications.

Dependents:

• Spouses and children can obtain TD status to accompany the TN-1 or TN-2 visa holder.
• TD status holders cannot work in the U.S., but spouses may qualify for TN-1 or TN-2 status or other non-immigrant visa statuses independently.
