Duration:
O-1 status may be granted for an initial stay of a maximum of three years and may be renewed indefinitely in one year increments.
Qualifications:
- Petitioner must have major international wards (e.g., Nobel Prize) or proof of accomplishments in at least 3 of 8 specific categories (e.g., recognized prizes, memberships, publications, or significant contributions)
- Comparable evidence may be submitted if standard criteria don’t apply.
Artists and Entertainers:
Artists and entertainers must prove they are recognized as prominent in their field. Motion picture and television professionals must show a record of extraordinary achievement, often demonstrated through awards like the Oscars or Emmy’s. Alternatively, proof of achievements in at least 3 of 6 specified categories (e.g., lead roles, critical acclaim, or high salaries) may suffice
Consultation Requirement:
A consultation with a peer group or labor organization is mandatory to confirm the applicant’s qualifications and the nature of the proposed work.
Derivative and Accompanying Visas:
- O-3 Visa (Family): Spouses and children under 21 may join but cannot work
- O-2 Visa (Assistants): Restricted to integral support roles in arts, motion picture, TV, and athletics. Applicant must demonstrate unique skills and maintain foreign residency.
